SW 30-19-28 W4M.

Amendment to the Heritage Pointe Area Structure Plan (ASP) and concurrent Land Use Redesignation with a Site Specific Amendment

The public hearing held on February 24, 2021, regarding the amendment to the Heritage Pointe Area Structure Plan (ASP) and concurrent Land Use Redesignation with a Site Specifc Amendment, has been rescheduled to Tuesday, March 9, 2021 at 9:00 a.m.

A Public Hearing for this application has been scheduled for February 24, 2021 at 10:00 A.M. Notice of the Public Hearing, including instructions on how to participate in the hearing was mailed to all landowners within the Hamlet of Heritage Pointe as well as to landowners within approximately one-half mile of the Hamlet of Heritage Pointe on February 5th, 2021. The Public Hearing Notice will also be published in the February 10th and 17th, 2021 editions of the Okotoks Western Wheel newspaper.
Foothills County has requested that the applicant revise the proposed amendment to the Heritage Pointe Area Structure Plan. A link to the revised ASP Amendment is provided below.
The revised ASP Amendment was requested by the County to address requirements of Alberta Transportation. The revisions pertain only to Section 06.1 Transportation – External Roads on pages 25 -26 and Policy 0.6.1.4 on page 28 of the proposed ASP Amendment and related figures.
- At the request of Alberta Transportation, Figure 8 on page 26, has been revised to show the interchange that was recommended in a 2005 study undertaken by the Province to determine the land requirements and design of an interchange at Dunbow Road and Macleod Trail (Highway 2A);
- Alberta Transportation felt that the figures that illustrated the western round-a-bout locations were incongruent to the recommended design for the interchange, therefore all figures and references to the round-a-bouts have been removed;
- Background information and policy have been revised to specify that further study and consultation will be undertaken by Foothills County in consultation with all stakeholders, including the surrounding community and Alberta Transportation to align an interchange at Dunbow Road and Macleod Trail and to accommodate future growth north and south of Dunbow Road.

The County received a revised application submission from Kristi Beunder of Township Planning + Design Inc. on behalf of the landowners Carolina Oxtoby and Douglas Howland with respect to a 24.39 acre Country Residential District parcel, legally described as Ptn. SW 5-22-29 W4; Plan 9912130 Blk 5. The revised submission included a copy of the January 2021 mail out, a FAQ document and a revised proposed amendment to the Heritage Pointe ASP (referred to as Serenity).
The proposed ASP Amendment contemplates the addition of a new development cell (referred to as Serenity and Cell E) inside the current boundaries of the Heritage Pointe ASP plan area and the Hamlet of Heritage Pointe. The subject parcel, legally described as Plan 9912130, Block 5; PTN. SW 05-22-29 W4M, is 24.39 acres and is currently zoned as Country Residential District. The new development cell is proposed to facilitate the future development of 49 Hamlet Residential District/Hamlet Residential Sub-district “A” lots and 22 Residential Multi-Family District lots (Villas). All lots are proposed to be serviced with piped water and wastewater from the existing Corix facilities that currently service the balance of the Hamlet of Heritage Pointe.
The concurrent land use redesignation application proposes to redesignate the subject 24.39 acre parcel from Country Residential District to Hamlet Residential District, Hamlet Residential Sub-district “A” and Residential Multi-Family District with a portion of the lands being dedicated as Municipal Reserve, Environmental Reserve, Environmental Reserve Easement and Public Utility. In addition, a Site Specific Amendment to the Residential Multi-Family District is proposed to allow for Single Family Dwellings as a Permitted Use and to allow for the current standard relaxations for the Hamlet of Heritage Pointe, including the addition of a front yard setback of 1.0m from property line to a major collector street.
