Annexation is the process of transferring land from one municipal jurisdiction to another. When land is annexed, the ownership of the land does not change, only the municipality that it resides in and whose bylaws it is subject to. Most annexations involve the transferring of land from a rural municipality to an urban municipality to accommodate urban growth, but rural municipalities can also annex land.

Following are some recent annexation applications that the M.D. of Foothills has been or is currently involved in:

Town of High River South and North East Annexation (2018-2019 amended 2014-2018 proposal)

Update: April 16, 2019

Foothills County will hold a non-statutory public hearing on May 22nd, 2019 to hear from impacted landowners and the public regarding the annexation of lands by the Town of High River and the draft Annexation Agreement.

The Town of High River held a non-statutory public hearing on March 25th, 2019 at which time Town Council gave staff direction to investigate the feasibility of excluding part of the annexation territory from the application. On April 8th,2019 subsequent to a presentation from staff, Town Council moved to proceed with the annexation application as it was proposed in the October 2018 Notice of Intent.

October 25, 2018 the Town of High River presented the M.D. with an amended Notice of Intent to Annex. This is an amendment to the Notice that was sent in November 2014. The stated reasons for the amended notice were as follows:

  • The size of the total proposed annexation area has changed from ±150 ha (370 acres) to ±101 ha (249 acres).
  • The areas proposed for annexation have changed
    • The quarter section east of 104th Street East (SW 31-18-28 W4) has been removed.
    • Lands between 112th Street East and Highway 2, south of 498th Avenue have been added
    • ±1.5 ha (3.82 acre) parcel in NW 35-18-29 W4M has been added.

The amendment to the Foothills / High River Intermunicipal Plan (IDP) to show the proposed annexation lands as Future Annexation Area (FAA) in the Future Land Use Scenario Map of the IDP was re-initiated this fall. Both municipalities have adopted bylaws to amend the map to facilitate the annexation.

The Town of High River held a public open house on the proposed annexation on Tuesday, November 27, 2018 at the Culture Centre from 3:00 to 6:00 pm. This event served to provide information to community members, stakeholders and the general public on the proposed annexation.

The two municipalities are now in the process of negotiating the Annexation Agreement that will lay out provisions for such things as taxation, compensation and the transfer process for planning and development applications.

Once a draft agreement has been completed, there will be a public hearing  to allow stakeholders and the public to express their views about the proposed annexation to Council.

A Jointly Hosted Public Open House on October 15, 2018, from 4 – 8 PM at the Black Diamond Council Chambers. Council representatives and administration from the Town of Black Diamond and the MD of Foothills will be in attendance to answer questions and receive feedback.

On October 2, 2017 the Town of Black Diamond submitted a Letter of Intent to Annex to the Municipal Government Board for approximately 464 acres of land in the MD of Foothills on the south side of the Town. 

On March 22, 2018 the Town of Black Diamond submitted an amended Letter of Intent that omitted some of the lands previously included reducing the proposed annexation area to approximately 308 acres.

Town of High River Southeast Annexation 2014-2018 (application revised see High River South and North East)

On November 12, 2014 the Town of High River submitted a Letter of Intent to Annex to the MD of Foothills for approximately 370 acres of land on the south-east side of High River. The lands are legally described as SE 31-18-28 W4, SW 31-18-28 W4, and Ptn. SE 36-18-29-W4M. 

The Town and the M.D. of Foothills hosted a joint public Open House on 22 January 2015 to provide an opportunity for residents and stakeholders to learn more about the intended expansion. Over the next number of months an annexation agreement was negotiated between the two municipalities. 

On April 1, 2015 the M.D. of Foothills Council held a public hearing on the agreement and subsequently tabled a decision for a future meeting.

The Town of High River Council held a public hearing on the annexation agreement on April 27, 2015 and approved the Annexation Agreement on May 11, 2015.

The Annexation Agreement is the key part of an annexation application and if both Councils do approve it, the annexation application could be forwarded to the Province. The Province’s Municipal Government Board will advertise the application and if they receive any statements of concern will hold an independent public hearing, they will then consider the application and forward a recommendation to the Provincial Government.

 

Town of Okotoks Annexation 2013-2017 

On September 26, 2013 the Town of Okotoks submitted a Notice of Intent thereby initiating a process to annex land to accommodate their growth needs for the next 60 years. The Town and the M.D. have spent a number of years negotiating an annexation agreement using a facilitated mediation process. Mediation concluded on March 29, 2016 when the Town of Okotoks and the MD of Foothills reached agreement in principle. The details of the agreement were outlined in a Memorandum of Understanding (MOU) that was brought before both MD and Town Councils who resolved at their respective meetings on April 6 and April 11, 2016 to support in principle the MOU.

The Town of Okotoks and M.D. of Foothills hosted a joint Open House on April 20, 2016 to provide an opportunity for residents and stakeholders to learn more about key elements of the negotiated MOU and to share concerns and ask questions of both municipalities with respect to the annexation. Subsequent to this, the Town and M.D. worked in cooperation to develop an Annexation Agreement.

On June 27th, 2016, the Town of Okotoks Council approved the Annexation Agreement.

The M.D. of Foothills Council held a non-statutory public hearing on the agreement on June 1, 2016 and approved the Annexation Agreement on July 6, 2016.

The Town of Okotoks submitted an Annexation Application to the Municipal Government Board (MGB) on September 9, 2016 for consideration. To view the application click here.

The MGB held a public hearing on Wednesday, October 12, 2016 at Foothills Centennial Centre, in Okotoks, Alberta.

The Okotoks annexation was completed and granted approval by the Municipal Government Board February 17, 2017 through Board Order MGB 007/17  to be effective on July 1, 2017.

 

 

Town of High River Northeast and Northwest Annexation 2010-2011

In 2010, the Town of High River and the MD of Foothills No. 31 negotiated an annexation agreement which would see 1730+/- acres of land annexed into the Town. This agreement was submitted to the Municipal Government Board

An appeal hearing was held in November of 2010 to address objections from landowners and freehold mineral rights holders.

September 16, 2011 the Municipal Government Board issued board order number MGB 060/11 approving the annexation application by the Town of High River effective January 1, 2012.

City of Calgary and MD of Foothills Annexations 2011

Sirocco Lands Annexation & Spruce Meadows Annexation - The Sirocco and Spruce Meadows Annexations have been completed and granted approval by the Municipal Government Board on March 3, 2011 through Board Order 018/11 to be effective on January 1, 2011.
